Often clients have a dispute with another party, but want the chance to try to “work things out” before using the court system. Mediation is a negotiation between the parties with a neutral third party mediator who helps the parties reach an agreement.
The mediator can discuss the merits of each party’s position and offer solutions for settlement, but the parties are not bound by the mediator’s recommendations. Sometimes mediation is voluntarily agreed to by the parties. Other times mediation is a requirement before a case can proceed forward on the merits in court. Arbitration also involves a neutral third party but unlike a mediator who is helping the parties negotiate with each other, the arbitrator makes a binding (final) decision. The arbitrator conducts a hearing and issues a decision. Arbitration is less formal than litigation in court but is more formal than mediation. Sometimes pre-suit arbitration is a requirement prior to filing a lawsuit, depending on what has led to your dispute.
